Terms of Service

These terms govern your access to and use of the Colliq platform. Please read them carefully. By using Colliq, you agree to be bound by these terms.

Acceptance of Terms

By accessing or using the Colliq platform ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you are using Colliq on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

If you do not agree to these Terms, you must not access or use the Service.

Eligibility

To use Colliq, you must:

  • Be at least 15 years of age.
  • Be a representative of an Australian Not-For-Profit, Small-to-Medium Enterprise, community organisation, or similar entity — or an individual user authorised by such an entity.
  • Not have been previously suspended or removed from the Service.
  • Comply with all applicable Australian laws and regulations.

Account Responsibilities

When you create a Colliq account, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information to keep it accurate.
  • Keep your password secure and confidential. You must not share your password or allow others to access your account.
  • Notify us immediately at support@colliq.co if you become aware of any unauthorised use of your account.
  • Accept responsibility for all activity that occurs under your account.
We strongly recommend enabling Multi-Factor Authentication (MFA) for all accounts, particularly those with administrative privileges.

Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Upload, post, or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Impersonate any person or entity, or falsely state your affiliation with any person or entity.
  • Use the Service to send unsolicited communications (spam) to other users or external parties.
  • Attempt to gain unauthorised access to any part of the Service or any third-party systems connected to it.
  • Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
  • Use automated tools (bots, scrapers, crawlers) to access the Service without our prior written permission.
  • Use the Service in any way that violates the Privacy Act 1988 (Cth), Spam Act 2003 (Cth), or any other applicable Australian law.
  • Collect or harvest personal information about other users without their explicit consent.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these provisions.

Subscription and Billing

5.1 Plans

Colliq may offer free and paid subscription plans. The features available to you depend on the plan your organisation subscribes to. Current plan details are available on our website.

5.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable. You authorise us (or our payment processor) to charge your nominated payment method for all fees due.

5.3 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until then. We do not provide refunds for partial billing periods except where required by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).

5.4 Price Changes

We will give you at least 30 days' notice before any price increase takes effect. Your continued use of a paid plan after the notice period constitutes acceptance of the new pricing.

Intellectual Property

6.1 Our Property

The Service, including its software, design, logos, trademarks, and all content created by Colliq, is owned by Colliq Pty Ltd and is protected by Australian and international intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

6.2 Your Content

You retain ownership of all content, data, and materials you upload to the Service ("Your Content"). By uploading content, you grant us a non-exclusive, royalty-free licence to store, process, and display Your Content solely as necessary to provide the Service to you.

You represent and warrant that you have all necessary rights to Your Content and that it does not infringe any third-party intellectual property rights.

Your Data

You are responsible for the accuracy and legality of all data you upload to Colliq, including volunteer records, member information, and event data. You must have appropriate authority and consent to input personal information about third parties (such as volunteers or contacts) into the platform.

We process your data in accordance with our Privacy Policy. Under Australian privacy law, you are the "data controller" for personal information belonging to your members, volunteers, and contacts — we act as a "data processor" on your behalf.

Third-Party Services

The Service integrates with third-party services including Google OAuth and payment processors. Your use of these integrations is subject to the respective third parties' terms and privacy policies. We are not responsible for the practices of any third-party services.

Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, except as required by Australian Consumer Law.

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under Australian Consumer Law that cannot be excluded.

Limitation of Liability

To the maximum extent permitted by Australian law, Colliq Pty Ltd and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from:

  • Your use of or inability to use the Service.
  • Any unauthorised access to or alteration of your data.
  • Any conduct or content of any third party on the Service.

Where liability cannot be excluded under Australian Consumer Law, our liability for a failure to comply with a consumer guarantee is limited to resupplying the service or paying the cost of having the service resupplied.

Indemnification

You agree to indemnify and hold harmless Colliq Pty Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) Your Content; (c) your breach of these Terms; or (d) your violation of any law or the rights of a third party.

Termination

We may suspend or terminate your access to the Service immediately, without prior notice, if we reasonably believe you have violated these Terms or any applicable law.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, your right to use the Service ceases immediately.

Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New South Wales, Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for the resolution of any disputes arising under these Terms.

Before initiating any formal legal proceedings, you agree to contact us at legal@colliq.com.au to seek an informal resolution. We will endeavour to respond and resolve disputes within 30 days.
